The Device Damage Program Terms and Conditions is facilitated by ProTech Solutions and is subject to the End User Agreement set forth by ProTech Solutions (“ProTech Solutions”, or “ProTech Devices”). THIS IS A SERVICE CONTRACT PROVIDING FOR THE FOLLOWING:

 

DEVICE DAMAGE FOR SCREEN CRACK AND BACK GLASS ONLY - LIMITED TO ONE (1) TIME REPAIR ONLY FOR SCREEN CRACK REPAIR AND ONE (1) TIME REPAIR ONLY FOR BACK SCREEN WITHIN THE APPROVED TERRITORY

  1. DURATION 

    1. The term of coverage is for 12 months commencing on the day of device purchase or activation of the OEM warranty

  2. THE PLAN

    1. This Repair Plan does not in any way constitute an insurance product offering or an event dependent coverage plan.  The Device Protection Plan only provides you access to repair services for your device at a pre-negotiated service fee for a fixed duration. 

    2. By activating the Plan in accordance with these Terms, you hereby agree to be bound by these Terms. These Terms govern Device Damage For Screen Crack And Back Glass Only - Limited To One (1) Time Repair Only For Screen Crack Repair AND One (1) Time Repair Only For Back Screen caused by Device Damage within the approved territory.  Service to be provided to you by ProTech Solutions  (Company No.: 4413751.01) (“ProTech Solutions”) under the Plan for EOM devices contained in its original packaging (“Covered Product”). 

    3. The Plan is considered consumed and all responsibilities from ProTech Solutions extinguished once services in item 2.2 have been fulfilled

    4. Device Damage means there is damage to your device, in particular screen crack or back glass damage

    5. The Plan is not transferable and or refundable in any circumstances

  3. WHEN THE PLAN COVERAGE BEGINS AND ENDS.

    1. Repair coverage for the Plan begins from the date of purchase or activation of the Covered Product whichever is earlier and ends on the 12th month from the purchase date or activation of the Covered Product (“Coverage Period”).

    2. The original sales receipt for your device is part of your service contract with ProTech Solutions. The price of the device is contained in the original sales receipt. Without the original receipt, your coverage will be terminated.

  4. WHAT IS COVERED?

    1. Coverage for ONE (01) Time Repair of Screen Crack and ONE (01) Time Repair of Back Glass 

      1. If during the Coverage Period, you will submit a valid Service Request to ProTech Solutions online by visiting www.ProTechDevices.com. ProTech Solutions will either (a) repair the Covered Product’s screen, using new or refurbished parts that are equivalent to new in performance and reliability, or (b) exchange the Covered Product’s screen with a replacement product that is new or equivalent to new in performance and reliability, and is at least functionally equivalent to the original product. 

      2. The Covered Product must have no additional damage other than to the screen or back glass as the case may be, including, but not limited to, a bent or dented enclosure, that would prevent the Service Center from replacing either the screen or back glass on the Covered Device. Covered Devices with additional damage will be charged to the Customer as Other Device Damage. 

      3. If ProTech Solutions exchanges the Covered Product, the title to the original product shall be transferred to ProTech Solutions and the replacement product shall be your property and the coverage of the Plan shall be terminated immediately.

      4. You are required to consult your Covered Product’s original manufacturer for any technical support to determine if the failure to operate is due to circumstances that may be corrected by yourself. If the nature of the defect is not covered by the Plan, you will be charged for the cost of the service repair. A diagnostic service fee will be charged if you decide not to proceed with the service repair or when a defect is found.

    2. Covered Product

      1. The Covered Product must be a device that is contained in its original packaging with valid manufacturer’s warranty. Further, the Plan only covers a Covered Product which:

        1. typically includes a marking such as a sticker with the markings of ProTech Solutions or ProTech Devices;

        2. is purchased from the authorised reseller of the Covered Product;

        3. must contain the certification mark from the original manufacturer of the Covered Product under law and be certified for sale and use in the approved territory by the relevant certification agency as required under law;

        4. has a Manufacturer warranty of 12 months that is valid in the approved territory included with the Covered Product at the time of purchase;

        5. is used for domestic and personal use only; and

        6. shall not be used in any commercial, rental or for-profit generation purpose within a multiple user organization or for commercial usage in residential areas.

    3. Service/Repair Fees:  In the event your covered product experiences a breakdown, you must pay a service fee as shown in the service fee schedule below.

      1. Damage Type

        1. Service Fee to be paid by Customer

          1. Front Screen

            1. USD50 or equivalent in local currency

          2. Back Glass

            1. USD50 or equivalent in local currency

        2. The amount shall be paid directly to the Service Center in the local currency converted at the prevailing rate at the time of the settlement and pickup of the repaired device.  ProTech Solutions is not party to the final settlement amount or currency conversion rate to be used by the Service Center. 

  5. WHAT IS NOT COVERED?

    1. The Plan does not apply to:

      1. mechanical and or electrical breakdown of Covered Product;

      2. additional spare parts damaged aside from the ONE (01) Time Carry In Screen Crack Repair and ONE (01) Time Carry In Back Glass Repair

      3. Covered Product with the serial number, part number, proof of purchase, warranty certificate and or E-Certificate that has been altered, defaced, destroyed and or duplicated.

      4. a Covered Product with removed and or altered serial numbers, part number and or IMEI;

      5. any damage or loss caused by the alteration, modification, repair and or maintenance of the Covered Product by any party not authorized by original manufacturer and or ProTech Solutions;

      6. installation of third-party parts will affect your Coverage. As a condition of obtaining Services, all Covered Equipment must be returned to ProTech Solutions in its entirety including all original parts or OEM-authorized replacement components. The restriction does not prejudice your consumer law rights.

      7. to replace Covered Product that is lost or stolen;

      8. any damage or loss caused by exposure to liquid / submersion in liquid

      9. any damage or loss caused by fraud;

      10. any damage or loss caused by wear and tear, degeneration, rust, mould, discoloration or cosmetic defects including defects to paintwork or product finish;

      11. any damage or loss that cannot be proved in accordance with the requirements of the insurer;

      12. any damage or loss caused by including without limitation by earthquake, volcanic eruptions, tsunami;

      13. any damage or loss caused by war, riots or uprising;

      14. any damage or loss caused by the execution of legal rights by national or public bodies or any third party, seizure, requisition, and confiscation;

      15. any damage or loss caused by computer viruses or any defect or any error in any software used upon or in association with the Covered Product;

      16. any damage or loss caused by Manufacturer's defects inherent in the Covered Product;

      17. any damage or loss caused by wear and tear to cables, cord assembly, battery packs, display panels, adaptors, covers, buttons, or speakers;

      18. any damage or loss of Peripheral equipment or components that have been bundled with the device (e.g., earphones);

      19. any damage or loss caused by improper usage or wrong electrical supply/voltage;

      20. any damage of the Covered Product resulting from over running, excessive pressure, short circuiting, self-heating, arching or leakage of electricity (Electrical Damages);

      21. any damage by fire, theft, burglary, neglect, misuse, or abuse. Acts of god including but not limited to earthquake, storm or tempest (wind), sand, water, flood, rising water, lightning, malicious damage, aircraft, vehicle impact, corrosion, battery leakage, power outages or surges, inadequate or improper voltage, or current, animal or insect infestation;

      22. any damage or loss of the Covered Product function due to manufacturer design flaw and or defect resulting to the original manufacturer’s Covered Product recall;

      23. appearance or structural items, such as housing, case or frame, decorative parts or parts designated to be replaced periodically during life of the Covered Product, add‐on items, accessories or attachments, external wiring and cabling, battery chargers, racks, bins, knobs, handles, antennas, remote control; or

      24. any software programs, whether provided with the Covered Product and or installed subsequently or any technical support;

      25. any Covered Product that is inoperable due to unauthorised modifications;

      26. any Covered Product not approved by ProTech Solutions.

  6. HOW TO OBTAIN SERVICE

    1. You may obtain the Services by visiting the ProTechDevices.com website and completing the request for service form and selecting your preferred ProTech Solutions Authorised Service Center.  You will need to wait for the approval email from ProTech Solutions before you may bring the device to a Protech Authorized Service Center for evaluation and repair.   

    2. You are required to provide Proof of Damage, Detailed Description on the Nature of Damage, Damage photos and Declaration of Terms & Conditions as part of the online service request you will complete. 

    3. There is a repair fee you will be charged when you bring your device for a repair under this Plan.  The repair fee will be directly payable to the Service Center.   Please see the fee table on 4.3

  7. MODE OF SERVICE DELIVERY

    1. ProTech Solutions will provide the repair Services through our authorized Service Centers.  The customer will be required to bring the device to the Service Center to avail of the service. The Service will be performed by an authorized Service Center for the Covered Product and the Service shall be completed in accordance with the service center terms and conditions. Service will only be provided for Covered Products that are determined to be compliant to the Terms and Conditions, including ensuring that the device was not subject to unauthorized service or any form of accidental damage (e.g., water exposure, drop, etc.).  The Service Center and ProTech Solutions will be the exclusive determiner of the validity of the device condition.  For Covered Products, once the Service is completed, you will be notified by the ProTech Solutions via email for the return of your device.

    2. ProTech Solutions reserves the right to change the method by which ProTech Solutions may provide repair or replacement service to you, and your Covered Product’s eligibility to receive a particular method of service. The Service will be limited to the options available in the country where Service is requested. Service options, parts availability and response times may vary according to country. You may be responsible for shipping and handling charges if the Covered Product cannot be serviced in the country it is in. 

  8. YOUR RESPONSIBILITIES

    1. To receive the repair Services under the Plan, you agree to comply with the following:

      1. provide all the supporting documents as required under these Terms;

      2. respond to requests for information, including but not limited to the Covered Product  IMEI, serial number, model, version of the operating system and software installed, any peripherals devices connected or installed on the Covered Product, any error messages displayed, actions taken before the Covered Product experienced the issue and steps taken to resolve the issue;

      3. comply with instructions from ProTech Solutions, including but not limited to refraining from packing the Covered Product in accordance with shipping instructions;

      4. Back Up The Software And Data Residing On The Covered Product. Protech Solutions, The Authorised Service Center And Or Its’ Appointed Service Center May Reinstall The Covered Product’s Original Software Configuration And Subsequent Update Releases While Performing Service, Which Will Result In The Deletion Of All Software And Data That Resided On The Covered Product Prior To Service. During Service, Protech Solutions, The Authorised Service Center And Or Its’ Appointed Service Center Will Delete The Contents Of The Covered Product And Reformat The Storage Media. Protech Solutions Will Return Your Covered Product As The Covered Product Was Originally Configured, Subject To Applicable Updates. Protech Solutions May Install Os Updates As Part Of Service. Third Party Applications Installed On The Covered Product May Not Be Compatible Or Work With The Covered Product Because Of the OS Update. You Will Be Responsible For Reinstalling All Other Software Programs, Data And Passwords.

      5. You are required to make the payment for the additional cost of service repair to avail of the Plan; you are required to pay for any excess beyond what is explicitly covered by the Device Protection Plan Agreement as mentioned in Section 4.

  9. LIMITATION OF LIABILITY

    1. To the maximum extent permitted by applicable law, ProTech Solutions and its employees and agents and its appointed service centers will under no circumstances be liable to you for any direct or indirect or consequential damages, including but not limited to any loss incurred due to any delay in rendering any services related to the plan and/or loss of use during the period that your covered product is undergoing the service at the authorised service center and/or awaiting for the replacement parts for the covered product, costs of recovering, reprogramming, or reproducing any program or data or the failure to maintain the confidentiality of data, any loss of business, profits, revenue or anticipated savings, resulting from ProTech Solutions’s obligations under this plan. to the maximum extent permitted by applicable law, the limit of protech solutions and its employees and agent’s liability to you arising under the plan shall not exceed the original price paid for the plan. ProTech Solutions specifically does not warrant that (i) it will be able to repair or replace the covered product without risk to or loss of programs or data, (ii) it will maintain the confidentiality of data, or (iii) that the operation of the product will be uninterrupted or error-free.

    2. ProTech Solutions at its sole discretion, may replace your covered product with one of a like kind and quality if the covered product is not repairable due to the part becoming obsolete or beyond economic repair. Due to technological advances, the replacement product may be of lower retail value than the original covered product. replacement parts will be original or third-party original equipment manufacturer’s parts that perform to factory specifications of the covered product and shall be determined at ProTech Solutions sole discretion. faulty parts and/or devices must be returned and become the property of ProTech Solutions. any such replacement will immediately terminate the plan.

  10. DATA STORAGE

    1. If your Covered Product is capable of storing any user data, it is possible that repairing your Covered Product may result in the loss of your data regularly. ProTech Solutions will not be liable for any loss of data or loss of use during the period that your Covered Product is undergoing the service at ProTech Solutions and or the authorised service center.

    2. ProTech Solutions will not be liable for any inconvenience, damage or loss incurred due to a loss of personal data at the hands of the Service Center.  Any and all action with respect to data loss or theft should be directed to the Service Center and is the sole responsibility of the Service Center to resolve with the customer.  

  11. TERMINATION

    1. The Plan shall be terminated immediately without any refund of the price paid for the Plan if any of the following events occur:

      1. expiry of the term of the Plan; or

      2. when the Covered Product has been repaired and or replaced and when the Plan has been consumed as fulfilled in item 2.2; or

      3. the disposal, subsequent sale, loss or repossession of the Covered Product by you; or

      4. the unauthorised repair or modification of the Covered Product; or

      5. upon discovery of fraud or misrepresentation; or

      6. breach of any of the Terms.

  12. PERSONAL DATA PROTECTION 

    1. Upon successful activation of your Plan, you agree that any information or data disclosed to ProTech Solutions under this Plan is not confidential or proprietary to you. Furthermore, you hereby agree and authorise ProTech Solutions and its authorised third parties such as service centers, contractors, insurers and or agents to collect, use and disclose personal data about you and or about other persons furnished by you, now and in the future, on manual and or computer files for administrative and customer care purposes (together with such other information supplied to or obtained by ProTech Solutions separately) including: (i) to allow ProTech Solutions to investigate, assess and or pay service repair fees under your Plan (ii) to provide you and or other persons with information on the products and services for marketing purposes; (iii) for market research and (iv) tracking of sales data. ProTech Solutions and or its authorised third parties may contact you and or these persons by post and telephone for these purposes. If there is any personal data relating to other individuals, you must have obtained prior consent from them (or if they are lacking in legal capacity, from their legal representatives, guardians or parents as the case may be) for ProTech Solutions and its above mentioned authorised third parties to collect, use and disclose their personal data for the above purposes, and as if they were you. All personal data you provide shall be accurate and complete, and you will inform ProTech Solutions of any changes to the personal data to your knowledge as soon as practicable. If you agree, ProTech Solutions may also contact you by e-mail, SMS text or fax for these purposes. You may opt out at any time allowing ProTech Solutions or its authorised agents to process your Information by writing to ProTech Solutions.

  13. GENERAL

    1. ProTech Solutions may subcontract or assign performance of its obligations to third parties but shall not be relieved of its obligations to you in doing so.

    2. ProTech Solutions is not responsible for any failures or delays in performing under the Plan that are due to events outside of ProTech Solutions’ s reasonable control.

    3. This Plan is offered and valid only if you are a resident of a country in which ProTech Solutions offers the Plan. This Plan is not offered to persons who have not reached the age of 18. This Plan is not available where prohibited by law.

    4. In carrying out its obligations ProTech Solutions may, at its discretion and solely for the purposes of monitoring the quality of ProTech Solutions’ response, record part or all of the communications between you and ProTech Solutions.

    5. The terms of the Plan, including the original sales receipt of the Plan and the Covered Product, prevail over any conflicting, additional, or other terms of any purchase order or other document, and constitute your and ProTech Solutions’ entire understanding with respect to the Plan.

    6. If you purchase this Plan online or from a retail outlet, you must submit your device to a ProTech Authorized device diagnostic and evaluation to ensure that the device is in good working order and can be enrolled in this Plan.  ProTech Solutions is not obligated to enrol any device that does not pass its evaluation criteria. In the event of a renewal of a plan, ProTech Solutions will determine the price and terms.

    7. With respect to any suit, action or proceedings relating to any dispute arising out of or in connection with these Terms, each party submits to the exclusive jurisdiction of the courts of the approved territory.

    8. This Plan is offered and valid only in the approved territory. The laws of the approved territory govern these Terms. Any items explicitly disallowed by the territory’s laws shall take precedence over any offering included in this Device Protection Program.

EXTENDED WARRANTY PLAN

DEVICES COVERED BY A 12 MONTHS EXTENDED WARRANTY:

 

  1. DURATION 

    1. The term of coverage is for 12 months commencing on the day after the expiry of the OEM warranty

  2. THE PLAN

    1. By requesting a service on your device, you hereby agree to be bound by these Terms. These Terms govern the Extended Warranty Services (“Service”) caused by Manufacturing Damage within the approved territory provided to you by ProTech Solutions FZC LLC (Company) with License Number 4413751.01 (“ProTech Solutions”) under the Plan for products sold and registered with ProTech Solutions (“Covered Product”). 

    2. 12 Months Extended Warranty means it warrants the device contained in the original packaging against defects in materials and workmanship when used normally in accordance with the manufacturer’s published guidelines.

    3. The Plan is not transferable and or refundable in any circumstances. In the event, the Covered Product under the Plan is replaced directly by the original manufacturer due to the original manufacturer’s recall, you must submit to ProTech Solutions the original manufacturer’s delivery receipt and serial number of the new product within three (3) days of the replacement.

  3. WHEN THE PLAN COVERAGE BEGINS AND ENDS.

    1. Coverage for the Plan begins from the date of expiry of the original warranty and ends on the 12th month from the expiry date of original warranty (“Coverage Period”). The original sales receipt for your device is part of your service contract with ProTech Solutions. The price of the device is contained in the original sales receipt. Without the original receipt, your coverage will be terminated.

  4. WHAT IS COVERED?

    1. Coverage for:

      1. Carry In Extended Warranty Repair Services

        1. If during the Coverage Period, you submit a valid claim by visiting the ProTech Solutions Authorized Service Center that a defects in material and workmanship happened on your Covered Product, ProTech Solutions will either (a) repair the Covered Product, using new or refurbished parts that are equivalent to new in performance and reliability, or (b) exchange the Covered Product with a replacement product that is new or equivalent to new in performance and reliability, and is at least functionally equivalent to the original product. If ProTech Solutions exchanges the Covered Product, the title to the original product shall be transferred to ProTech Solutions and the replacement product shall be your property and the coverage of the Plan shall be terminated immediately.

        2. You are required to consult your Covered Product’s original manufacturer for any technical support to determine if the failure to operate is due to circumstances that may be corrected by yourself. If the nature of the defect is not covered by the Plan, you will be charged for the cost of the service repair. A diagnostic service fee will be charged if you decide not to proceed with the service repair or when a defect is found. The OEM’s published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications

      2. Limits of Warranty coverage

        1. The coverage is limited to a maximum value of USD700 for the entire duration of the Plan.  If there is more than one service / repair required during the life of the Plan, the total amount spent on service or repair to date will be accumulated and any excess beyond the maximum value covered will have to be borne by the customer or the repair will not be carried out.  

        2. Should there be a need to fully replace a device, the Plan is considered consumed and all obligations for repair under the Extended Warranty provision are extinguished.  

  5. WHAT IS NOT COVERED?

    1. Software distributed by the OEM with or without the OEM brand (including, but not limited to system software) is not covered by this Warranty. Please refer to the licensing agreement accompanying the software for details of your rights with respect to its use, ProTech Solutions does not warrant that the operation of the OEM Product will be uninterrupted or error-free. ProTech Solutions is not responsible for damage arising from failure to follow instructions relating to the OEM Product’s use. The Plan does not apply to:

      1. a Covered Product with the serial number, part number, proof of purchase, warranty certificate and or E-Certificate that has been altered, defaced, destroyed and or duplicated.

      2. a Covered Product with removed and or altered serial numbers and part number;

      3. any damage or loss caused by the alteration, modification, repair and or maintenance of the Covered Product by any party not authorized by original manufacturer and or ProTech Solutions;

      4. any damage or loss caused by wilfully, recklessly, or intentionally;

      5. any damage or loss caused by negligence or carelessness;

      6. any damage or loss caused by fraud;

      7. any damage or loss caused by sabotage;

      8. to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship.

      9. any damage or loss that cannot be proved in accordance with the requirements of the insurer;

      10. any damage or loss caused by including without limitation by earthquake, volcanic eruptions, tsunami;

      11. any damage or loss caused by war, riots or uprising;

      12. any damage or loss caused by the execution of legal rights by national or public bodies or any third party, seizure, requisition, and confiscation;

      13. any damage or loss caused by nuclear fuel substances or radioactivity;

      14. any damage or loss caused by computer viruses or any defect or any error in any software used upon or in association with the Covered Product;

      15. any damage or loss caused by wear and tear to cables, cord assembly, battery packs, display panels, adaptors, covers, buttons, speakers, computer keyboards and mouse.

      16. any damage or loss of Peripheral equipment or components that do not have independent functions. This includes, without limitation, equipment or components worn out through the use of the Covered Product and the accessories bundled or purchased separately with the Product (including Battery/Charger/Earphone);

      17. any damage or loss caused by neglect, misuse, abuse, improper installation, improper usage or wrong electrical supply/voltage or failure to operate the Covered Product in accordance with the instructions provided by the manufacturer of the Covered Product;

      18. any damage or loss caused by voltage converter and or applying incorrect voltage to the Covered Product;

      19. any damage of the Covered Product resulting from over running, excessive pressure, short circuiting, self-heating, arching or leakage of electricity (Electrical Damages);

      20. any damage of the Covered Product resulting from explosion or machinery breakdown;

      21. any damage by fire, theft, burglary, neglect, misuse, or abuse. Acts of god including but not limited to earthquake, storm or tempest (wind), sand, water, flood, rising water, lightning, malicious damage, aircraft, vehicle impact, corrosion, battery leakage, power outages or surges, inadequate or improper voltage, or current, animal or insect infestation;

      22. appearance or structural items, such as housing, case or frame, decorative parts or parts designated to be replaced periodically during life of the Covered Product, add‐on items, accessories or attachments, external wiring and cabling, battery chargers, racks, bins, knobs, handles, antennas, remote control; or

      23. any software programs, whether provided with the Covered Product and or installed subsequently. Any technical or other support, such as assistance with "how‐to" questions and those regarding product set‐up and installation.

      24. any Covered Product that is inoperable due to unauthorised modifications or has failed due to catastrophic damage, such as the covered product separating into multiple pieces, are ineligible for service.

      25. to cosmetic damage, including but not limited to scratches, dents, and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship.

      26. any Covered Product not approved by ProTech Solutions.

  6. HOW TO OBTAIN SERVICE

    1. You may obtain the Services by visiting the ProTechDevices.com website and completing the request for service form and selecting your preferred ProTech Solutions Authorised Service Center.  You will need to wait for the approval email from ProTech Solutions before you may bring the device to a Protech Authorized Service Center for evaluation and repair.

Service will only be provided for Covered Products that are determined to be compliant to the Terms and Conditions, including ensuring that the device was not subject to unauthorized service or any form of accidental damage (e.g., water exposure, drop, etc.).  The Service Center and ProTech Solutions will be the exclusive determiner of the validity of the device condition.  For Covered Products, once the Service is completed, you will be notified by the ProTech Solutions via email for the return of your device.

    2. ProTech Solutions reserves the right to change the method by which ProTech Solutions may provide repair or replacement service to you, and your Covered Product’s eligibility to receive a particular method of service. The Service will be limited to the options available in the country where Service is requested. Service options, parts availability and response times may vary according to country. You may be responsible for shipping and handling charges if the Covered Product cannot be serviced in the country it is in. 

  8. YOUR RESPONSIBILITIES

    1. To receive the Services under the Plan, you agree to comply with the following:

      1. provide all the supporting documents as required under these Terms;

      2. respond to requests for information, including but not limited to the Covered Product serial number, model, version of the operating system and software installed, any peripherals devices connected or installed on the Covered Product, any error messages displayed, actions taken before the Covered Product experienced the issue and steps taken to resolve the issue;

      3. comply with instructions from ProTech Solutions, including but not limited to refraining from packing the Covered Product in accordance with shipping instructions;

      4. Back Up The Software And Data Residing On The Covered Product. Protech Solutions, The Authorised Service Center And Or Its’ Appointed Service Center May Reinstall The Covered Product’s Original Software Configuration And Subsequent Update Releases While Performing Service, Which Will Result In The Deletion Of All Software And Data That Resided On The Covered Product Prior To Service. During Service, Protech Solutions, The Authorised Service Center And Or Its’ Appointed Service Center Will Delete The Contents Of The Covered Product And Reformat The Storage Media. Protech Solutions Will Return Your Covered Product As The Covered Product Was Originally Configured, Subject To Applicable Updates. Protech Solutions May Install Os Updates As Part Of Service. Third Party Applications Installed On The Covered Product May Not Be Compatible Or Work With The Covered Product Because Of the OS Update. You Will Be Responsible For Reinstalling All Other Software Programs, Data And Passwords.

      5. You are required to make the payment for the additional cost (if any) of service repair if the nature of the damage is not covered by the Plan as mentioned in Section 4.

  9. LIMITATION OF LIABILITY

    1. To the maximum extent permitted by applicable law, ProTech Solutions and its employees and agents and its appointed service center will under no circumstances be liable to you for any direct or indirect or consequential damages, including but not limited to any loss incurred due to any delay in rendering any services related to the plan and/or loss of use during the period that your covered product is undergoing the service at the authorised service center and/or awaiting for the replacement parts for the covered product, costs of recovering, reprogramming, or reproducing any program or data or the failure to maintain the confidentiality of data, any loss of business, profits, revenue or anticipated savings, resulting from ProTech Solutions’s obligations under this plan. to the maximum extent permitted by applicable law, the limit of protech solutions and its employees and agent’s liability to you arising under the plan shall not exceed the original price paid for the plan. ProTech Solutions specifically does not warrant that (i) it will be able to repair or replace the covered product without risk to or loss of programs or data, (ii) it will maintain the confidentiality of data, or (iii) that the operation of the product will be uninterrupted or error-free.

    2. ProTech Solutions at its sole discretion, may replace your covered product with one of a like kind and quality if the covered product is not repairable due to the part becoming obsolete or beyond economic repair. Due to technological advances, the replacement product may be of lower retail value than the original covered product. replacement parts will be original or third-party original equipment manufacturer’s parts that perform to factory specifications of the covered product and shall be determined at ProTech Solutions sole discretion. faulty parts and/or devices must be returned and become the property of ProTech Solutions. any such replacement will immediately terminate the plan.

  10. DATA STORAGE

    1. If your Covered Product is capable of storing any user data, it is possible that repairing your Covered Product may result in the loss of your data regularly. ProTech Solutions will not be liable for any loss of data or loss of use during the period that your Covered Product is undergoing the service at ProTech Solutions and or the authorised service center.

    2. ProTech Solutions will not be liable for any inconvenience, damage or loss incurred due to a loss of personal data at the hands of the Service Center.  Any and all action with respect to data loss or theft should be directed to the Service Center and is the sole responsibility of the Service Center to resolve with the customer.  

  11. TERMINATION

    1. The Plan shall be terminated immediately without any refund of the price paid for the Plan if any of the following events occur:

    2. expiry of the term of the Plan; or

    3. when the Covered Product has been repaired and or replaced and when the Plan has been consumed as fulfilled in item 2.2; or

    4. the disposal, subsequent sale, loss or repossession of the Covered Product by you; or

    5. the unauthorised repair or modification of the Covered Product; or

    6. upon discovery of fraud or misrepresentation; or

    7. breach of any of the Terms.

  12. PERSONAL DATA PROTECTION 

    1. Upon successful activation of your Plan, you agree that any information or data disclosed to ProTech Solutions under this Plan is not confidential or proprietary to you. Furthermore, you hereby agree and authorise ProTech Solutions and its authorised third parties such as service center, contractors, insurers and or agents to collect, use and disclose personal data about you and or about other persons furnished by you, now and in the future, on manual and or computer files for administrative and customer care purposes (together with such other information supplied to or obtained by ProTech Solutions separately) including: (i) to allow ProTech Solutions to investigate, assess and or pay service repair fees under your Plan (ii) to provide you and or other persons with information on the products and services for marketing purposes; (iii) for market research and (iv) tracking of sales data. ProTech Solutions and or its authorised third parties may contact you and or these persons by post and telephone for these purposes. If there is any personal data relating to other individuals, you must have obtained prior consent from them (or if they are lacking in legal capacity, from their legal representatives, guardians or parents as the case may be) for ProTech Solutions and its above mentioned authorised third parties to collect, use and disclose their personal data for the above purposes, and as if they were you. All personal data you provide shall be accurate and complete, and you will inform ProTech Solutions of any changes to the personal data to your knowledge as soon as practicable. If you agree, ProTech Solutions may also contact you by e-mail, SMS text or fax for these purposes. You may opt out at any time allowing ProTech Solutions or its authorised agents to process your Information by writing to ProTech Solutions.

  13. GENERAL

    1. ProTech Solutions may subcontract or assign performance of its obligations to third parties but shall not be relieved of its obligations to you in doing so.

    2. ProTech Solutions is not responsible for any failures or delays in performing under the Plan that are due to events outside of ProTech Solutions’ s reasonable control.

    3. This Plan is offered and valid only if you are a resident of a country in which ProTech Solutions offers the Plan. This Plan is not offered to persons who have not reached the age of 18. This Plan is not available where prohibited by law.

    4. In carrying out its obligations ProTech Solutions may, at its discretion and solely for the purposes of monitoring the quality of ProTech Solutions’ response, record part or all of the communications between you and ProTech Solutions.

    5. The terms of the Plan, including the original sales receipt of the Plan and the Covered Product, prevail over any conflicting, additional, or other terms of any purchase order or other document, and constitute your and ProTech Solutions’ entire understanding with respect to the Plan.

    6. If you purchase this Plan online or from a retail outlet, you must submit your device to a ProTech Authorized device diagnostic and evaluation to ensure that the device is in good working order and can be enrolled in this Plan.  ProTech Solutions is not obligated to enrol any device that does not pass its evaluation criteria. In the event of a renewal of a plan, ProTech Solutions will determine the price and terms.

    7. With respect to any suit, action or proceedings relating to any dispute arising out of or in connection with these Terms, each party submits to the exclusive jurisdiction of the courts of the approved territory.

    8. This Plan is offered and valid only in the approved territory. The laws of the approved territory govern these Terms. Any items explicitly disallowed by the territory’s laws shall take precedence over any offering included in this Device Protection Program.
